Draft — not yet in force. Last edited [DATE].
These terms govern your use of SpotView. SpotView is pre-launch and not yet taking bookings; these terms describe the service as it will operate when it opens.
SpotView is operated by [LEGAL ENTITY NAME], [LEGAL FORM], KvK number [KVK NUMBER], registered at [REGISTERED ADDRESS]. You can reach us at [CONTACT EMAIL].
SpotView is a reporting and attendance service. You book a viewing yourself; we send a verified local person to attend it on your behalf and deliver a structured report.
We are not a rental broker (bemiddelaar). We do not arrange viewings, do not represent you, do not negotiate on your behalf, do not make decisions for you, and we give no guarantee about the outcome of your rental application.
Our viewers are independent contractors, not our employees. They set their own availability and choose which bookings to apply for.
You must already have a viewing appointment with a confirmed or pending date and address. SpotView does not create appointments.
You are responsible for telling the landlord or agency that a representative will attend on your behalf. We give you suggested wording, but the arrangement is yours to make.
If your viewer is refused entry because that arrangement was not made, you receive a 50% refund and your viewer will instead deliver a neighbourhood tour and a legitimacy check on the address.
Prices are shown on our pricing page and include Dutch VAT at the applicable rate. Express is an optional add-on charged on top of the tier price.
Payment is held in escrow and is only released once your viewing is complete and your report has been delivered. If no viewing takes place, you are not charged.
[Describe the payment provider, when the card is authorised versus captured, and the refund mechanism, once payments are integrated.]
Once your report is delivered you have 24 hours to review it. If something is demonstrably missing, you may claim a refund of up to the full amount within that window.
After 24 hours the payment is released to your viewer and the booking is final.
[This clause must be checked against Dutch consumer law, including the statutory right of withdrawal for distance contracts (Art. 6:230o BW) and the conditions under which a consumer can waive it for a service that starts within the withdrawal period. The 24-hour window cannot override a right the consumer has by law.]
Give accurate information about the viewing — a wrong address or time means the viewing cannot be attended.
Do not ask your viewer to do anything unlawful, unsafe, or outside the scope of attending and reporting on the viewing.
Treat your viewer with respect. We may refuse service or close an account for abusive behaviour.
A report reflects one person's observations during one visit. It is a structured, honest account — not a survey, a valuation, a building inspection, or professional advice.
You decide what to do with it. [State what rights you grant SpotView over report content and what rights you retain — this needs drafting.]
[To be drafted by a lawyer. Any limitation of liability must be checked against Dutch law on unfair terms in consumer contracts (Art. 6:236–6:237 BW, the 'black' and 'grey' lists); a limitation that is standard in a B2B contract may be void against a consumer. Do not publish a placeholder limitation.]
If something goes wrong, contact us first at [CONTACT EMAIL] and we will try to resolve it.
[State the governing law and the competent court, and check whether the mandatory consumer-jurisdiction rules apply. Consider whether registration with a disputes body (geschillencommissie) is appropriate.]
[Describe how these terms may change and how existing users will be notified. Changes cannot be applied retroactively to a booking already made.]
